At SkateDash, we recognize that privacy is very important.  We are committed to protecting your privacy rights and have set forth our responsibilities and your responsibilities in this Privacy Policy.  As more fully explained below, we collect, use and disclose your personal information or aggregate information collected about you in order to facilitate billing, enable communication from coaches to skaters, and to provide you, the user, with a more personalized experience when using the SkateDash Site and Services.  We may also use your personal information to periodically inform you about changes to our Services and Site and tell you about new programs.

I. Introduction

This Privacy Policy (the “Privacy Policy”) governs how My Skate Space, LLC d/b/a SkateDash (along with its affiliates, officers, directors, representatives, agents, employees and assigns, “SkateDash,” the “Company,” “we” or “us”) manage the security and privacy of the personal information that you provide to us.  This Privacy Policy contains a statement of principles and guidelines for the protection of personal information and the users (“you,” or “user(s)”) of our Services and Site.

Nothing in this Privacy Policy creates or adds to any right or claim (whether legal, equitable or otherwise) that any individual or person may have at law or otherwise against SkateDash, nor will the existence of this Privacy Policy or its application impose any obligations or liability upon SkateDash that the Company does not already have to any individual or person at law or otherwise.

Capitalized terms used herein and not otherwise defined shall have the meanings assigned to such terms in the SkateDash Terms and Conditions to which this Privacy Policy is made a part of and incorporated therein by reference in its entirety.

Your Consent

BY SUBMITTING PERSONAL INFORMATION TO SKATEDASH, YOU AGREE THAT SKATEDASH OR ITS LEGAL AGENTS MAY COLLECT, USE AND DISCLOSE SUCH PERSONAL INFORMATION AS DESCRIBED IN AND ACCORDING TO THIS PRIVACY POLICY OR AS OTHERWISE REQUIRED BY LAW.  Subject to certain restrictions, you may withdraw your consent at any time to the use of your personal information.  Should you withdraw your consent to the use of some or all of your personal information, you may not be able to use some or all of the SkateDash Services nor have full functionality of the SkateDash Site.  Furthermore, with respect to the personal information you provide about another individual, you represent and warrant that you have all necessary authority and/or have obtained all necessary consents from that individual to enable SkateDash to use, collect and disclose such personal information for the purposes set forth in this Privacy Policy.

II. Personal Information

“Personal Information” is defined as information about an identifiable individual and does not include general or aggregated information that does not allow an individual to be identified.  When you consent to and provide SkateDash with your personal information, we use it to:  (i) communicate with you via the Site, email, and/or through texts;  (ii) personalize your experience when using our Site; (iii) collect information for SkateDash reporting and analytics;  (iv) schedule lessons and billings between coaches and student skaters;  and (v) allow skaters to view a roster of coaches and receive communications from coaches of their choice.

Personal Information You Provide to Us.  When signing up for SkateDash Services on the Site, communicating with SkateDash via email or text, participating in a SkateDash program or promotion or taking a SkateDash survey, SkateDash may collect certain personal information about you including:

(i.)  your name and/or the name of your minor child, address, phone number, email address, your birthday and/or the birthday of your minor child, and your or your minor child’s gender.

(ii.)your billing information including: your bank information (i.e. routing number and account number); credit or debit card number, identifying information related to the intended form of payment, and a username and password related thereto.

It is important to note that children under the age of 13 are NOT ALLOWED to submit personal information about themselves.  As set forth more fully in the Terms and Conditions, a parent or legal guardian must provide any personal information about a child under the age of 13, and SkateDash requires that parent or legal guardian’s prior written consent to do so.  If SkateDash has actual knowledge that a minor under the age of 13 has created a SkateDash account, SkateDash will remove the account and deny use of the Site and its Services to such user.

Personal Information SkateDash Collects from You Automatically.  SkateDash also collects and uses aggregated information (information that does not personally identify you) about you automatically in order to personalize your experience as well as collect certain information for SkateDash to use in its reporting.  For example, when accessing our Site, we automatically collect your computer’s IP address, browser preference and language, SkateDash widgets, pages viewed, time spent on each page and your geographic location.  SkateDash also collects information about your preferences in the form of cookies or other like technologies, to better serve you.  You may change your preferences with respect to cookies on your browser’s settings or you may reset your browser to delete cookies already stored.  If you decide to disable SkateDash cookies, some features of the SkateDash Site and Services may not function properly.

 III. Accessing and Updating Your Personal Information

When you use SkateDash Services and the SkateDash Site, we make good faith efforts to provide you with access to your personal information or to delete such data at your request, provided that it is not otherwise required to be retained by law or for a legitimate business reason.  It is your responsibility to update your personal information and to ensure its accuracy, or to promptly inform SkateDash of a change to your personal information, particularly with respect to your contact or billing information.

 IV. Information Sharing

 SkateDash only shares your personal information in the following limited circumstances:

When we have your consent. We require opt-in consent for the sharing of any personal information.

  1. To facilitate communication from coach to skater and from SkateDash to its users;

  2. [To develop, enhance, market, sell, provide and inform users of products and services of third parties, including affiliates and trusted business partners/persons with whom SkateDash has a relationship;]

  3. To understand and respond to user needs and preferences, including to communicate with our users to provide technical support;

  4. To manage and develop SkateDash’s business and operations;

To, in good faith, (A) comply with any applicable law, regulation or legal process or enforceable government request; (B) to enforce applicable Terms and Conditions, including investigations of potential violations thereof, (C) to detect, prevent or otherwise address fraud, security or technical issues, or (D) to protect against imminent harm to the rights, property or safety of SkateDash, its users or the public, as required by law; and

  6. For any other purposes with user consent.


If SkateDash becomes involved in a merger, acquisition or any form of the sale of substantially all of its assets, we will provide notice to you before personal information is transferred.  If you consent to your personal information being transferred, collection, use and disclosure of your personal information may be governed by a different privacy policy.

SkateDash may share certain pieces of your aggregated non-personal information with third parties without your consent.  Aggregated information does not identify you personally.

V. External Links

SkateDash Site may contain hypertext or links to third parties.  These links are provided for your convenience.  Any information, products, services or opinions expressed on external sites are not controlled, sponsored or approved by SkateDash.  SkateDash expressly disclaims any legal responsibility for any information, opinions, products or services available on these external sites.

VI. Security of Your Personal Information

SkateDash uses industry standard administrative and technological safeguards appropriate to the sensitivity of the personal information provided in order to protect against unauthorized access to, alteration, destruction or disclosure of the personal information.  These measures include, but are not limited to:  maintaining secure data networks protected by firewall and password protection systems, internal review of our data collection, storage and processing practice and internal review of our security measures.

VII.     Your Consent

            By using SkateDash Services and the Site, you consent to the collection, use and disclosure of your personal information by SkateDash, as set forth in this Privacy Policy.  Continued use of the Service or Site shall constitute your express acceptance of this Privacy Policy.
